Terms of Service

1) Eligibility (21+)

You must be at least 21 years old and able to form a binding contract to use the Service. You are responsible for ensuring your use complies with applicable laws in New Zealand and where you access the Service.

2) Accounts & security

You may need an account to access features. Provide accurate information, keep credentials secure, and notify us of unauthorised use. We may suspend or terminate accounts for suspected misuse.

3) Gameplay, points & virtual items (no real-world value)

• Any points, coins, credits, streaks, badges or other virtual currency/items (“Virtual Items”) are for entertainment and gameplay only.
• Virtual Items have no monetary value, are not legal tender, are not redeemable for cash or anything of real-world value, and are not transferable or sellable.
• No cash-out, prize redemption, wagering, or gambling is offered or permitted through the Service.
• We may modify, reset, or remove Virtual Items (including balances) as part of updates, anti-cheat measures, or Service changes.

4) Purchases & billing (if offered)

If we offer paid subscriptions or in-app purchases for Virtual Items or features: prices are shown at checkout; applicable taxes (including NZ GST where required) may apply; payments are processed via the stated payment method. Unless required by New Zealand law, purchases are non-refundable and cannot be exchanged for cash. We may change pricing prospectively and will disclose material changes where required.

5) Acceptable use

• Do not cheat, exploit bugs, use bots, scrape, reverse engineer, or interfere with the Service.
• Do not upload or share unlawful, harmful, or infringing content, or attempt unauthorised access to accounts or systems.
• Use the Service for personal, non-commercial entertainment unless we expressly agree otherwise.

6) Content & intellectual property

We (or our licensors) own the Service, software, branding, and content. You receive a limited, revocable, non-exclusive licence to use the Service as permitted by these Terms. If you submit content, you grant us a worldwide, non-exclusive, royalty-free licence to host, use, reproduce, and display it to operate and improve the Service.

7) Disclaimers

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim warranties including merchantability, fitness for purpose, and non-infringement. Nothing in these Terms limits rights you may have under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 where applicable.

8) Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages, loss of profits, loss of data, or loss of goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim (or NZD $100 if you paid nothing), except where liability cannot be limited under New Zealand law.

9) Suspension, termination & changes

We may suspend or terminate access for violations, security reasons, or to comply with law. We may update the Service and these Terms; continued use after changes take effect means you accept the updated Terms.

10) Privacy

11) Governing law

These Terms are governed by the laws of New Zealand. The courts of New Zealand have non-exclusive jurisdiction over disputes, unless mandatory law provides otherwise.
